RE: The tariff classification of Airline Travel Kit for Animals from China

Dear Ms. Baker:

In your letter dated February 12, 2015, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is described as an Airline Travel Kit for Animals. The product consists of one double-cup plastic bowl for food and water, one absorbent kennel pad, 8 aluminum alloy bolts (measuring approximately 1.25 inches) and nuts, 8 aluminum alloy bolts (measuring approximately 1.75 inches) and nuts, 9 plastic zip ties for door security and as shipping I.D. sticker. The sample will be returned, as requested.

It is the opinion of this office that “Airline Travel Kit for Animals” is not a set for tariff purposes. This airline travel kit for animals meets criterion (a) and (c), but does not meet criterion (b). The items included in the kit are used for divergent purposes, such as maintenance and animal comfort. Since the items in the kit are put together to carry out several different activities or to meet several different needs, they do not satisfy criterion (b) in Explanatory Note X to Rule 3(b). The airline travel kit for animals is not considered to be a set, so we return to GRI 1 to classify each item of the kit separately.

The applicable subheading for the Plastic Bowl and Plastic Zip Ties will be 3926.90.9995, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics…: other: other…other. The duty rate will be 5.3 percent ad valorem.

The applicable subheading for the Absorbent Kennel Pad will be 9619.00.1100, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Sanitary towels (pads) and tampons, diapers and diaper liners for babies and similar articles, of any material: Of paper pulp. The rate of duty will be Free.

The applicable subheading for the Animal Labels will be 4818.90.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for which provides for paper and paperboard labels of all kinds, whether or not printed: other (than printed): pressure-sensitive. The rate of duty will be free.

The applicable subheading for the Steel Bolt and Aluminum Nuts will be 7318.15.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers(including spring washers) and similar articles, or iron or steel: threaded articles: Other screws and bolts, whether or not with their nuts or washers: Bolts and bolts and their nuts or washers entered or exported in the same shipment: Having shanks or threads with a diameter of less than 6mm. The rate of duty will be Free.

The applicable subheading for Shipping I.D. Sticker will be 4820.10.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for memorandum pads, letter pads and similar articles, of paper or paperboard. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
